Experience

 

Thabo completed his Bachelor Law Degree (LLB) at the University of Venda. He has vast knowledge and experience of Labour law and is currently the Managing Director at Lebea Inc. in the Corporate Commercial department.

 

He specialises in Corporate and Commercial Law, Employment and Litigation and Dispute Resolution. He has been acting for domestic and multinational clients in diverse industries and sectors including Local Government, Public Government, Advertisement, Insurance, Aviation in both listed and unlisted corporate environments. Thabo has assisted many companies in structuring, negotiating and leading complex corporate transactions.

 

In addition, Thabo also has experience in negotiating and drafting tailor-made commercial agreements. He specialises in large employment law matters. His expertise covers business transfers, retrenchment (dismissals for operational requirements), misconduct cases, sexual harassment, unfair labour practices, social media law and engagement and termination of executives.

 

He specialises in the representation of clients in the disciplinary hearings, CCMA Arbitrations, and other tribunals. He further sits in various tribunals wherein he chairs disciplinary hearings and other dispute resolution mechanisms. He also appears on behalf of clients at various forums including the Labour Court, High Court, Supreme Court of Appeal, Constitutional Court and Commission for Conciliation, Mediation and Arbitration (CCMA).

 

Thabo conducts seminars, presentations, training and workshops on various topics in his areas of expertise (as indicated above). He also gives talks / takes part in discussion panels across the country on these topics. Thabo specialises in domestic and cross-border litigation, with expertise in arbitration and High Court litigation.

 

Thabo has advised clients extensively in transactional disputes, shareholder and company law disputes, contractual claims and insolvency and business rescue issues. Thabo has successfully represented numerous clients, including banks, financial institutions, insurers, mining houses, pharmaceutical companies, construction companies, hotel groups and I.T companies.

 

Thabo advises clients and litigates for and against Public Entities as defined in the Public Finance Management Act in matters relating to, inter alia, Procurement Law, Administrative Law, Constitutional Law and other related areas of law. Thabo has had many successes in guiding both public and private sector clients through the complex regulatory regime of public procurement processes.

 

Thabo also advise corporate clients and government bodies on the application and interpretation of laws and on administrative action. On the public sector side, he has assisted with the design and implementation of fair tender processes that meet the stipulated constitutional principles. On the private sector side, he has advised clients on the procurement of goods and services by organs of state and help them challenge tender processes that do not meet constitutional standards. Thabo regularly represent clients in proceedings before statutory bodies that regulate diverse areas of economic and social activity.

 

Thabo’s expertise in constitutional and administrative law makes him one of the leading practitioners in judicial review proceedings. A significant area of his work involves advising clients on the procurement of goods and services by organs of state. Thabo has assisted private sector clients to challenge procurement processes which fall foul of these requirements and vice versa.
