• Tebogo has advised the then Minister of Public Works, Honorable Thoko Didiza and the Council for Built Environment in regard to the revision of the Built Environment Professions Legislation. He also acted as the lead drafter for the Department of Public Works during the legislative process in Parliament as well at the Parliamentary Portfolio Committee hearings.
• Tebogo and Bonang participated in the Parliamentary Portfolio Committee hearings of the Economic Development relating to the Competition Amendment Bill. They made oral representations in Parliament and they were leading the Expert Panel advising the Honourable Minister Patel with the practical effects of implementing the amendments.
• Tebogo, Bonang and Ally have assisted the Health Professions Council of South Africa (“HPCSA”) with various revisions of its Ethical Rules of Conduct for Practitioners registered under the Health professions Act.
• Tebogo and Bonang have advised the Construction industry Development Board (cidb) on required legislative revisions to its Regulations.
• Tebogo previously assisted the Land and Agricultural Development Bank of South Africa (Landbank) when it initiated the process of reviewing the Land and Agricultural Development Bank Act, 2002 (“the Act”), with a view to recommending amendments thereof to the relevant authorities. Our instructions were to assist the Bank with identifying areas of the Act that should be considered for amendment and to map out the legislative process going forward. We continued this work in 2022 wherein we were instructed to review specific aspects of the Act the Bank intends recommending amendments on to the relevant authorities.
• We assisted the National Housing Finance Corporation SOC Ltd (“NHFC”) with drafting the Human Settlement Development Bank (“HSDB”) Bill as well as providing an opinion relating to various issues arising from the establishment of the HSDB. These issues included advising on the processes that the NHFC must undertake to achieve the intention of the National Department of Human Settlement (“NDoHS”) of establishing the HSDB, and conducting a review of the policy documents prepared and submitted with respect to the establishment of the HSDB as a public entity in order to determine whether same require updating in line with NHFC’s current requirements.
• We advised the Gauteng Provincial Treasury on the establishment of a State Pharmaceutical Company. Our terms of reference included advise the Department on the following issues:
• Regulatory framework and requirements, dashboard feasibility assessment and processes related to the establishment of a state owned pharmaceutical company;
• The suitable approach to be considered in giving effect to the aforesaid mandate;
• Advise on any other detail not considered in respect of the regulatory limitations and restrictions as may be applicable to the public sector in relation to the procurement and supplies of medicines and medical devices;
• Guide the Department on the regulatory provision that may be relied upon in giving effect to the mandate contemplated herein, and
• Guide the Department on the list of legal documents, governance requirements and regulatory processes to be considered in relation to the establishment of a state-owned pharmaceutical company.
